Will cookies make your business crumble?

On 26 May the law changed and all businesses must now obtain their website users’ permission to use cookies.

What is a cookie?


Cookies are small text files that are stored on a user’s machine to help identify them and their preferences. Find out more.

For those who aren’t aware of the current law, there are two key areas that should be taken into account in order to comply with the new regulations:

Information: Visitors of your website must be made aware that the website uses cookies and explain what they are for. This must be presented in a clear, accessible and understandable manner.

Choice: Visitors must be instructed how to opt out if they wish, regardless of the negative effects this may have on functionality.

The Information Commissioner (ICO) has been tasked with ensuring that sites comply with the directive. By not complying with this law, you may be liable for fines up to £500,000 for the most serious breaches.

Whilst such a fine is unlikely, it may be that the ICO seeks other sanctions against you (such as setting a deadline for compliance). The ICO has recently stated that it would not take immediate action over non-compliant sites and would instead offer guidance.
